General Sales Conditions (GSC)

Reference language : the version in French is authoritative. Translations are provided for information only; in case of discrepancy, the French version prevails.

1) Scope, integration and contractual documents

1.1. These GCS apply to all cycling events (the "Events") organized by DUBRAQUET SARL (the "Organizer"), in particular Aurora Gravel Rally Series (AGRS).

1.2. The GCS govern the participation contract concluded when registering on the ticketing/registration platform. They are brought to your attention of the contractual partner ("participant/shopper") prior to the order and accepted via a checkbox. The online version archived at the time of registration is authoritative.

1.3. The Contractual partner is the person purchasing the services via the platform. Where the registration includes participation rights for third parties (the "Participants"), the Contractual Partner acknowledges that it is acting on their behalf, their have communicated terms and conditions and Race Regulationsand collect any required consents (e.g. image rights, declarations).

1.4. The Race Regulations published for each Event is an integral part of the contract. The personal liability statement of each Participant, signed where applicable in the form required by the Organizer, is a condition of admission. Failing this, admission may be refused without entitlement to participation.

2) Event services

2.1. Registration confers a right to participate in accordance with the GCS, the Regulations and subject to the submission of the required declarations.

2.2. The services included are described on the Event page and summarized in the registration confirmation.

2.3. Events take place in open air and depend on actual conditions (weather, security, authorities). The Organizer may adapt services (e.g. itinerary, stages) or cancel parts of them for reasons justified reasonstaking into account, as far as possible, the interests of the Participants.

2.4. Participation rights are nominative and non-transferable, except single replacement (substitution) of a Participant until D-14 via the ticketing platform.

2.5. Race documents are issued upon presentation of the registration confirmation, the required declarations and proof of identity. No postal delivery is foreseen.

2.6. Bike box : the bike case can be dropped off at the accreditation office against a collection ticket. Transport/storage is provided until Finish (return to airport not included, separate option when available).

2.7. The additional services (e.g. bike care+, massages) are not included. not included without explicit reservation. Spare parts and work not covered remain the responsibility of the Participant according to the tariff displayed by the service provider.

3) Price, currency, payment and absence of statutory right of withdrawal

3.1. The price are displayed in EUR (euro) and in CHF (Swiss franc) on the registration platform, all taxes and non-optional charges included.

3.2 Payment methods: credit card via the platform, bank transfer and, for certain customers, SEPA direct debit. The Contractual Partner ensures that the account has sufficient funds.

3.3. Unless otherwise specified, charges must be paid in full in the 14 days following confirmation of registration. In the event of non-payment by the due date, the Organizer may cancel registration.

3.4. Payment by instalments (option) 50 % on reservation, balance due no later than D-90. In the event of non-payment of the balance by D-90, registration will be cancelled. canceled and thedeposit retained to the Organizer by way of cancellation fees, without prejudice to any more favourable rights provided for by law. 3.5. No legal right of withdrawal: under Swiss law, there is no not general online cancellation period. All cancellations follow the Cancellation and refund policy.

4) Cancellation and refund policy

Visit AGRS cancellation and refund policy makes integral part of these General Terms and Conditions. In particular, it deals with cancellation deadlines/rates, refunds/credits, transfers/substitutions, postponements due to force majeure, administrative costs and payment management.

Acceptance is required for registration.

5) Force majeure, impossibility, postponement or cancellation by the Organizer

6) Minimum number of Participants

If the minimum required from 100 participants for 5-day events and 150 participants for 2-day events is not reached, the Organizer may cancel the Event by notifying J-30. Participation fees are reimbursed. Other expenses (travel, hotel) remain the responsibility of the Contractual Partner.

7) Liability

7.1. Principle : the Organizer is liable in accordance with Swiss law. No exclusions is not valid in the event of dol or serious misconduct.

7.2. In the event of minor faultresponsibility is limited at direct, immediate, foreseeable and typical damage of the contract. Visit consequential damages and consecutive (e.g. loss of earnings, loss of data, travel/accommodation expenses) are excluded.

7.3. The above limitations do not apply to injury to life, limb or health caused by a fault of the Organizer.

7.4. The Organizer is not liable for damage not caused by himself (e.g. behaviour of other road users or third parties, legal/administrative restrictions preventing participation).

7.5. Mandatory provisions remain reserved.

8) Partner obligations and indemnification

8.1. The Contractual Partner is liable for damages caused to persons or property. He/she guarantees the Organizer against third-party claims directly attributable to its fault (or to that of the Participants it has registered), to the extent permitted by law.

8.2. The Partner declares participate on your own responsibilityThis clause is subject to the terms and conditions of the Event (weather, terrain, traffic, wildlife, etc.). This clause does not waiver of rights in the event of dol or serious misconduct of the Organizer.

8.3. The Participant confirms that he/she is suitable and able to evolve in self-sufficiency (navigation, provisioning, health, repairs, bivouac) and undertakes to respect the traffic regulations and the environment.

8.4. Goods and effects : The Organizer, its volunteers, partners and sponsors are not liable for the loss, theft or damage of goods (including bicycles, equipment, vehicles) on the sites and trails of the Event, to the extent permitted by Swiss law and subject to fraud and gross negligence.

9) Race Regulations

Visit Race Regulations makes integral part of these GTC. In particular, it covers participation conditions, individual sponsors, image rights, etc.

Acceptance is required for registration.

10) Event communication channels

10.1. Exchanges via official channels (e.g. groups WhatsApp/Signal) are reserved for the use of the Event. It is prohibited collect/use the contact details of other Participants for unsolicited advertising or private purposes. Respect for privacy and courtesy is required.

10.2. Communications : With his/her consent, the Participant may receive information and offers relating to the Events. They may withdraw their consent at any time. Some data is required for sports management and security purposes; otherwise, participation cannot be guaranteed (see Privacy policy).

11) Insurance

Each Participant must have: (i) a private liability insurance in force; (ii) a accidents insurance covering search/evacuation/repatriation costs; (iii) a medical expenses coverage abroad (iv) a accidental death coverage. A certificate can be requested.

12) Emergency care

The Participant agrees to receive any emergency care deemed necessary by the medical teams and authorizes the Organizer and its representatives to consent thereto if the Participant is unable to do so. He/she accepts that strictly necessary health information may be communicated to the service providers concerned and assumes responsibility for any costs not covered by his/her insurance, in compliance with applicable data protection law.

12) Autonomy

The Participant must remain stand-alone throughout the race (power, equipment, safety, orientation, repairs). Possible checks on mandatory equipment refusal to inspect may result inexclusion.

13) Miscellaneous

13.1. Document integration : visit GSC, the Cancellation and refund policythe Race Regulations, the Personal liability statement and, where applicable, the conditions of the registration platform form the contractual package. They can be accessed before the order, archived and can be downloaded.

13.2. Written form : no ancillary oral agreements. Modifications/additions require the written form (e-mail admitted). Priority is given to individual agreements.

13.3. Partial nullity : if a clause is invalid, the remainder remains applicable. The Parties shall agree in good faith on an economically equivalent valid clause.

13.4. Prior mediation (optional) : In the event of a dispute, the Parties may, before taking any legal action, attempt a short mediation with a center recognized in Switzerland. Failing agreement, the competent courts remain those designated in §13.5.

13.5. Applicable law and place of jurisdiction : right switzerland. For La Chaux-de-Fonds (NE)subject to mandatory rules of the country of residence.
